Yes. Whether the host followed local Los Angeles registration laws or not, Airbnb’s Host Liability Insurance is generally designed to protect the guest. In fact, if the unit was unpermitted or violated Encino’s strict Home-Sharing ordinances, it can actually strengthen your case by proving the host was operating a hazardous, non-compliant property.
Never accept an “off-platform” settlement. These offers are almost always significantly lower than what is required for long-term recovery and are designed to protect the host’s “Superhost” status rather than your health. Once you accept a private payment, you may forfeit your right to file a formal claim through Airbnb’s $1M liability policy.
